Terms of Use

These terms are an agreement between you and Sviatoslav Nahirnyi ("we", "us"), the developer of Fortium. They cover your use of the Fortium app and its online services: backup, AI features and subscriptions. By using Fortium you agree to them. If you don't agree, please don't use Fortium.

1. The app licence

Your licence to use the Fortium app is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add the rules for Fortium's services. If they conflict on the licence itself, the Standard EULA wins.

2. Who can use Fortium

You must be at least 13 years old, or the age of digital consent in your country if that is higher. If you are under 18, you need permission from a parent or guardian.

3. Your account

Fortium creates an anonymous account when you start, with no sign-up, so you can log right away. Your training backs up to it on its own, to servers in the EU, whenever you're online. There's no sign-in yet, so only your iPhone can reach that backup; export your data from time to time if you want a copy of your own. Keep your device secure; you are responsible for activity on it.

4. Free and Fortium Pro

Free includes unlimited workout logging and your full history, targets and progression on every set, records and charts, the rest timer and calculators, a program of any length run week by week plus unlimited routines, Strong and Hevy CSV import, data export, and one AI import or one AI-built plan with 5 coach messages.

Fortium Pro adds the AI coach, more AI imports and AI-built plans, a weekly AI check-in and deeper progress analysis.

Fair use. To keep AI costs sustainable, Fortium Pro includes up to 20 AI imports, 15 AI-built plans and 150 coach messages in any 30 days. During the free trial the limits are 5 imports, 3 plans and 40 coach messages. The app shows you when you get close to a limit.

We may improve or change Pro features over time. Logging, your history and data export will stay free.

5. Subscriptions and billing

  • Fortium Pro is sold as an auto-renewing subscription through Apple's App Store. Payment is charged to your Apple ID when you confirm the purchase.
  • Your subscription renews automatically at the same price and period unless you cancel it at least 24 hours before the end of the current period. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
  • Free trial: the 7-day free trial is for new subscribers to the yearly plan. It converts to a paid subscription unless you cancel at least 24 hours before it ends. Any unused part of a trial ends when you buy a subscription.
  • Cancel or manage: open your iPhone Settings › your name › Subscriptions › Fortium. Cancelling stops the next renewal; you keep Pro until the end of the period you paid for.
  • Refunds are handled by Apple under its policies. Request one at reportaproblem.apple.com.
  • Restore purchases: on a new device, use Restore purchases in the app (Profile › Fortium Pro).
  • Prices are shown in the App Store in your local currency and may change. Apple will tell you in advance of a price increase as its rules require.

6. AI features

Fortium's AI can read programs you import, build a program and answer as a coach. AI output can be incomplete or wrong. Review every imported program and every suggestion before you train. The coach proposes changes; nothing changes in your program until you approve it. You decide what you lift. To report a reply, email us at sviatoslav.nahirnyi@gmail.com. 7. Health and safety

Strength training carries a risk of injury. Fortium is a training log and planning tool. It is not a medical device and does not give medical advice, diagnosis or treatment. Talk to a doctor before starting a new exercise program, especially if you have a health condition, an injury or are pregnant. Use proper form, use spotters or safety equipment for heavy lifts, and stop if something hurts. For pain or injury, see a doctor or physiotherapist.

8. Your content

You own the workouts, programs, notes, files and messages you put into Fortium. You give us a limited licence to store and process them only to provide Fortium to you, including sending them to our AI provider when you use AI features. Only import material you have the right to use. We don't claim ownership of your content and we don't use it to advertise.

9. Acceptable use

Don't misuse Fortium. In particular, don't try to get around usage limits or subscriptions, reverse engineer or overload our servers, use automated tools to access the AI features, try to extract the AI's instructions, or use Fortium for anything unlawful or harmful.

10. Changes, suspension and ending

We may update Fortium, add or remove features, or stop offering a service, and we'll give reasonable notice of significant changes. We may suspend access if you seriously or repeatedly break these terms. You can stop using Fortium at any time and delete your data, your account and its backup in Profile › Privacy & data › Delete all data on this device.

11. Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. It also doesn't affect your statutory rights as a consumer.

Otherwise, Fortium is provided "as is" and "as available". We are not liable for losses that were not reasonably foreseeable, for loss of data you could have exported or backed up, or for business losses. Our total liability to you for any claim is limited to the greater of the amount you paid for Fortium in the 12 months before the claim and £50.

12. Apple

These terms are between you and us, not Apple. Apple is not responsible for Fortium or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it against you.

13. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts.

14. Changes to these terms

We'll update the date at the top when we change these terms and tell you in the app before material changes take effect. If you keep using Fortium after that, the new terms apply.
